Equestrian Sport Analytics LLC Privacy Notice

This Privacy Notice (“Notice”) describes Equestrian Sport Analytics LLC’s (“ESA,” “we,” “us,” or “our”) practices regarding the collection, use and disclosure of your personal information that we collect via the equestriansportanalytics.com website, applications, data storage (including backup and recovery repositories), services and tools. By using ESA’s Services, you accept this Notice and agree to the collection and use of your personal information in accordance with this Notice and subject to the applicable state and federal laws of the United States.

1. Collection of Information Sent Automatically

1.1 When you use ESA Services, we collect information sent automatically to us by your computer, mobile phone or other access device. The information sent to us may include your computer IP address, unique device identifiers, the type of operating system you’re using, your location or GPS/geo-location, mobile network information, standard web log data and other information. Web log data includes the browser type you’re using and traffic to and from our site. We may use third-party analytics tools, such as Google Analytics, to collect this information. 

1.2 We may receive information about you from third parties, such as certain information about your use of ESA Services if you access ESA Services through a third-party connection or log-in (e.g., through Facebook). 

1.3 We and our service providers may use tracking tools including cookies, web beacons, GIFs, pixels, device identifiers and other online information gathering tools (collectively “cookies”) from time to time to increase your security, provide you with a better experience when visiting the equestriansportanalytics.com website and mitigate risk and prevent fraud. You are free to decline our cookies if your browser or browser add-on permits but doing so may interfere with your use of the ESA Services.

We collect information from you when you use ESA Services. The information that we collect may include the following:

· detailed information on horses you own or have access to, including name, national and international registration numbers, and competition records;

· information from Social Media Services in accordance with your privacy settings with the applicable Social Media Service if you access our Service through a Social Media Service; and/or

· any other information you provide to us when you interact with us and ESA Services.

3. Information Collected from Other Sources

We collect information about you from commercially or publicly available sources to help us deliver features directly related to the services available through the website. Such sources may include information from equestrian federation databases, competition websites, aggregators and other sources for horse pedigree, performance results or competition video. We may use this information consistent with this Privacy Policy. 

4. How We Use Your Information

We use, process and disclose the information we collect about you for our business purposes, including:  

· Communicating about your account. We may contact you to deliver service update notices, tell you about changes to this Privacy Policy or our Terms of Use.

· Delivering ESA Services. We use your information to notify you about report updates, deliver relevant member content and otherwise respond to your questions and requests. 

· Improving our products and services. We may use your information to enhance or improve ESA services, including to personalize our service offerings and to detect and prevent fraud.

· Reviewing Trends and Member Interests. We may combine the information we receive from you with information from other members or received from third parties to assess trends for use as ESA content or dissemination to third parties. 

· Other uses. We may also use your information with your consent or as otherwise permitted or required by law.

5. What Information We Disclose

We may share your information with third parties in order to conduct our business; when legally required; or with your consent; including:

· Other Users. We may use either/both personal information or aggregated statistics to provide content to other ESA users, for example, horses with the highest clear round average or most common faults at a particular competition.  

· Service Providers. We may disclose the information collected about your to our third-party service providers relating to their performance of services on our behalf, including the maintenance and support of ESA Services and payment processing;

· Affiliates. We may share your information with our affiliates for business, operational, promotional, marketing or other purposes consistent with this Privacy Policy.

· Other Third Parties. We may disclose the information collected about you to other third parties in connection with our marketing efforts to promote our services or with the sale or transfer of our business or assets.

· Legal Process. We may disclose information about you to law enforcement, government officials, or other third parties as required by law or pursuant to a subpoena, court order, or other legal process or requirement; or when we believe, in our sole discretion, that the disclosure of personal information is necessary to prevent physical harm or financial loss, to report suspected illegal activity or to investigate violations of our Terms of Use.

6. Information from Children

equestriansportanalytics.com is a general audience site and it is not intended for children under the age of 13. We do not knowingly collect personal information via our websites, applications, services, or tools from users in this age group.

7. Data Security and Retention 

We store and process your personal information on our servers in the United States. We maintain reasonable technical, physical, and administrative security measures designed to protect the security of your personal information against loss, misuse, unauthorized access, disclosure, or alteration. 

We retain information as long as it is necessary and relevant for our operations, typically for as long as a user has an account, though in some instances information may be stored after an account is closed.

8. How to Change Your Personal Information or Close Your Account

All communication regarding your account should be directed via email to support@equestriansportanalytics.com. If you close your account, we will mark your account in our database as “Closed,” pursuant to our Privacy Policy. Likewise, if your account or membership is terminated or suspended, we may maintain some information to prevent re-registration.

9. How to Access Your Personal Information 

9.1 Right to Know. Residents of the State of California may request a list of all third parties to which our online service has disclosed certain personal information (as defined by California law) during the preceding year for those third parties’ direct marketing purposes.  If you are a California resident and want such a list, please contact us at support@equestriansportanalytics.com.  In the body of your request, please provide enough information for us to determine if this applies to you.  You need to attest to the fact that you are a California resident and provide a current California address for our response.  

9.2 Right to Delete. For California residents, if you would like to request that we delete your personal information, please click contact us at support@jump-clear.com and provide the requested information.

9.3 Emails. You can change your preferences by emailing support@equestriansportanalytics.com indicating that you no longer wish to receive marketing communications. Alternatively, you may opt out of our email communications by tapping “unsubscribe” and the bottom of any mass email sent by ESA.

10. Notification Regarding Updates

We reserve the right, at our discretion, to modify our privacy practices and update and make changes to this Privacy Policy at any time and without prior notice. If we make any changes, we will inform you by placing a notice on the jump-clear.com website.

11. Governing Law

By choosing to visit our Services, you agree that any dispute over privacy or the terms contained in this Privacy Policy will be governed by the law of the State of Florida, without reference to the choice of law or conflicts of law principles thereof, and will be subject to the dispute resolution clause contained in the Terms of Use applicable to the Services. This Privacy Policy is incorporated into and subject to the Equestrian Sport Analytics Terms of Use.
